The gathering brought together representatives from numerous schools operating on community lands, including Kahcharie, Shamilat, and state-owned lands, to discuss the pressing issues arising from the judgement and to explore strategies for ensuring the continued education of thousands of students. The conference was honored by the presence of Senior Counsel Advocate Zaffar Shah as the Chief Guest, along with other notable guests, including PSAJK President G N Var, Advocate Asif Feroz, and PSAJK Chief Organizer Shah Gulzar. In his opening remarks, PSAJK Chief Organizer Shah Gulzar stated, "Today's meeting is a vital step in our journey to protect the rights of our schools and the future of our students. The recent High Court judgement has significant implications, and our agenda today is to chart a clear and strategic path forward," emphasizing the critical nature of the discussions. A key highlight of the event was the insightful address by Senior Counsel Advocate Zaffar Ahmad Shah, who delved into the legal aspects of the J&K High Court's recent order. He provided a thorough explanation of the judgement, focusing on its impact on schools operating on state and community lands. "The High Court's ruling offers a structured approach for schools to regularize their land status, ensuring compliance with the law while securing the future of educational institutions in Jammu and Kashmir. This is a significant relief for schools facing uncertainty," Advocate Shah explained, shedding light on the legal avenues available to the schools. Advocate Shah further elaborated on some details of the High Court judgement: The Hon'ble Jammu & Kashmir, Ladakh High Court, under the guidance of Acting Chief Justice Tashi Rabstan, recently provided crucial relief to private schools operating on state and community lands. The court ruled that these schools could either acquire proprietary land or approach the relevant authorities, including the Principal Secretary to the Government, Department of School Education, U.T. of J&K, and the J&K Board of School Education, to consider their pleas. This process may involve land exchanges under applicable laws. Schools have been given a four-week window to submit their applications, with decisions expected within four months. Importantly, schools are permitted to continue their operations during this period, ensuring no disruption to students' education. PSAJK President G N Var presided over the conference, expressing his deep appreciation for the participation of legal experts, school representatives, and other stakeholders. He emphasized the importance of unity and strategic action in navigating the challenges posed by the recent judgement. "This court order is not just a legal victory; it is a beacon of hope for thousands of students and their families. Our collective efforts will ensure that education remains uninterrupted and that our schools thrive in the face of adversity," Var said. Advocate Asif Feroz, who served as a legal counsel in this case, emphasized the importance of proactive measures, stating, "This judgement is not just a temporary relief but a stepping stone towards securing the future of our educational institutions. It is crucial that we take swift and coordinated action to ensure compliance and safeguard the rights of schools and their students." In his closing remarks, PSAJK President G N Var extended a heartfelt vote of thanks to all attendees, acknowledging their commitment to the cause of education. He also presented mementos to Senior Counsel Advocate Zaffar Shah and Advocate Asif Feroz, recognizing their invaluable contributions to the conference and the broader educational community. The PSAJK conference marked a significant milestone in the ongoing efforts to protect and advance the interests of private schools operating on state and community land in Jammu and Kashmir. The Association reaffirmed its dedication to advocating for these schools, ensuring that the education of thousands of students remains secure in the wake of the J&K High Court's judgement. The conference not only provided clarity on the legal aspects of the judgement but also set the stage for future actions to safeguard the rights of private educational institutions in the region.
